Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Andromeda Enclave LLC, a California limited liability company doing business as Star Phlux ("Star Phlux," "we," "us," or "our"). They govern your access to and use of starphlux.com, the Star Phlux portal, Ask PHLUX, astrology charts, written readings, live offerings, question credits, communications, and related products and services (collectively, the "Services").

Please read these Terms carefully. By creating an account, clicking to accept, purchasing, or using the Services, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services. The Services are not offered to minors, and you may not submit birth details or other personal information about anyone under 18.

If you use the Services for an organization, you represent that you have authority to bind that organization to these Terms. You may use the Services only where doing so is lawful.

2. What Star Phlux provides

The Services may include:

• astrology chart calculation and verification;
• Ask PHLUX, an AI-assisted conversational astrology experience;
• individual, relationship, synastry, composite, transit, and other readings;
• downloadable or portal-based written reports;
• free question allowances and one-time purchases of question credits;
• connected adult accounts with optional shared credits and separate private conversation areas;
• The Threshold, a thirty-morning course delivered as one letter each morning by email, with optional text messages: text delivery is never required, you opt in by giving a mobile number and checking the consent box, message and data rates may apply, and you can stop the texts at any time by replying STOP or removing your number in your account, which does not affect the email letters or your access to the course;
• Your Sky Today, a daily text-message subscription: one text each morning at about 6am with a link to that day's read of your own chart. The first three mornings are free. It then renews at $11 per month for a reading of your own chart, or $15 per month when you add a second person and receive the relationship reading as well, billed through Stripe, until you cancel. You can cancel at any time by replying STOP to any text, from your account settings, or by emailing admin@starphlux.com; cancellation stops future charges and texts at the end of the current billing period. Text delivery requires your opt-in consent, and message and data rates may apply.
• live sessions offered or arranged separately; and
• related account, invitation, purchase, reading-ready, and service communications.

Specific descriptions, prices, delivery details, and any additional terms presented on an offering, checkout, or booking page are part of these Terms. If those specific terms conflict with these general Terms, the specific terms control for that offering.

We may add, change, or discontinue features prospectively. We will not begin recurring charges without presenting separate recurring-payment terms and obtaining the affirmative consent required by law. Apart from Your Sky Today, Star Phlux sells only one-time purchases; no other product involves a subscription or automatic renewal.

3. Ask PHLUX and AI disclosure

Ask PHLUX is an AI system, not a human astrologer. An “About PHLUX” link sits in the Ask PHLUX footer at all times and states this plainly, and Ask PHLUX will confirm it whenever you ask. This notice is provided in addition to these Terms so that no one is left to assume a person is on the other side. Written briefs and readings are also generated in whole or in part with artificial intelligence using chart calculations, Star Phlux instructions and interpretive materials, information supplied by users, and relevant conversation context. Star Phlux currently uses Anthropic's commercial API for this generation.

The system may maintain a private memory containing summaries and facts from your conversations so that later answers have context. Star Phlux may check chart calculations, review selected or flagged content, and audit outputs for accuracy, but human review is not a guarantee that every statement in every output has been individually reviewed.

AI output can be false, incomplete, misleading, repetitive, offensive, or inconsistent, even when a chart calculation is accurate. You are responsible for evaluating each output and independently checking factual assertions before relying on them. An answer may not reflect recent facts outside the chart and information supplied to the system.

4. Astrology and professional-services disclaimer

Star Phlux provides astrology-based content for entertainment, reflection, insight, and personal growth. Astrology is interpretive and is not a scientifically established method for predicting events, evaluating compatibility, diagnosing conditions, or determining what any person should do.

The Services do not provide, and are not a substitute for, medical, mental-health, psychological, legal, financial, tax, crisis, domestic-violence, or relationship-safety advice. Star Phlux is not acting as your physician, therapist, lawyer, financial adviser, emergency responder, or other licensed professional. Do not use the Services to make or replace professional judgments or major decisions about health, safety, treatment, money, legal rights, employment, housing, insurance, or whether to remain in or leave a relationship.

No chart, reading, conversation, date range, or other output promises a particular event or outcome. Do not assume that a human is monitoring a conversation in real time or that Star Phlux can contact emergency services for you. If you are in danger, facing a crisis, or considering harming yourself or someone else, stop using the Services and contact local emergency services, a qualified crisis resource, or an appropriate professional.

Crisis and safety protocol

Ask PHLUX is designed to recognise language suggesting a risk of suicide or self-harm. When it does, it is instructed to stop the astrological reading, respond with care, and show crisis resources: in the United States, the 988 Suicide and Crisis Lifeline (call or text 988); elsewhere, the international directory at findahelpline.com; and, in an emergency, local emergency services. It does not attempt counselling, does not continue the reading in that turn, and does not contact anyone on your behalf. Star Phlux publishes the full protocol at starphlux.com/safety and reviews it at least annually. Automated detection can miss things and can misfire; if you are in crisis, use the resources above directly.

5. Accounts and security

You must provide accurate account information and keep your email address current. Depending on the sign-in method, your first name may function as an account identifier. Account credentials and magic links are personal to you. Do not share them or permit another person to use your account. Connected adults should use separate logins.

You are responsible for activity under your account unless caused by our breach of these Terms or failure to use legally required care. Protect your password, email account, devices, and sign-in links, and notify admin@starphlux.com promptly if you suspect unauthorized access.

You may not impersonate another person, create an account for a minor, or use false information to evade a suspension or credit limit. We may require reasonable verification before restoring access or fulfilling a privacy, refund, or account request.

6. Information about other adults

The Services may let you submit a partner's, former partner's, family member's, or another adult's name, birth details, and relationship context even if that person does not have a Star Phlux account.

By submitting information about someone else, you represent and warrant that:

• the person is at least 18;
• you have the legal right to provide and use the information for the requested Service;
• your submission does not violate a law, duty of confidentiality, contract, court order, or the person's privacy or other rights; and
• the information is accurate to the best of your knowledge and is not being submitted to harass, stalk, manipulate, threaten, or harm anyone.

Do not submit another person's health, mental-health, reproductive-health, sexual-health, treatment, or similarly sensitive information unless that person has expressly authorized it and you are legally permitted to do so.

When appropriate, you should give that person a copy of our Privacy Policy. If the person exercises a valid privacy right, we may delete or restrict the information and any associated chart, conversation, or reading, even if that changes content available to you. You agree to cooperate with reasonable questions necessary to address such a request.

Acceptance records

When you create an account, buy something, or accept an updated version of these Terms, the portal records the fact, the version accepted, the time, and technical details of the request such as an IP address. Those records are how we show that you agreed.

7. Connected accounts, private conversations, and shared credits

Every Star Phlux account belongs to one person. You may add another adult's birth details to your account to receive a relationship reading from your side. That person is not contacted, receives no access, and is not a party to your account. If you invite them to Star Phlux, they create their own separate account with its own credits and readings; nothing links the two accounts and nothing from your conversations is visible to them. Section 6 governs the information you submit about another adult.

8. Purchases, prices, taxes, and credits

Prices and amounts of credits are shown before purchase and are charged in U.S. dollars unless checkout states otherwise. Applicable taxes may be added and shown at checkout. Payments are processed by Stripe, whose terms and privacy practices also apply to its processing.

Except for Your Sky Today, all current purchases are one-time purchases. Purchasing a reading or question pack does not enroll you in a subscription or authorize an automatic renewal.

Paid question credits do not expire. They are not currency, do not earn interest, and may not be sold, bartered, or transferred except through a Star Phlux sharing feature. They are not redeemable for cash except where applicable law requires otherwise. Free questions, promotional credits, discounts, and credits issued as a courtesy may be changed or withdrawn before use unless prohibited by law.

If we permanently discontinue the paid question service while your account has unused paid credits, we will provide a reasonable opportunity to use them or issue a proportionate refund, as applicable. We may correct a balance affected by an error, reversed payment, chargeback, fraud, or unauthorized use.

9. Refunds, cancellations, and delivery

Question packs

You may request a refund for a completely unused question pack within 14 days after purchase by emailing admin@starphlux.com. A pack is unused only if none of its credits have been consumed. Merely allowing a connected user to draw from a shared balance does not count as use, but the pack is no longer completely unused once either user consumes a credit from it. Once any credit from a pack has been used, the pack is non-refundable except where applicable law requires otherwise.

Personalized written readings

You may request cancellation until generation is complete. Once a personalized reading has been generated, it is non-refundable because it is made for the birth information supplied, except where applicable law requires otherwise.

We aim to make a purchased written reading available within 72 hours after payment clears and we receive all complete and usable birth information required for the reading. If we do not deliver within that period, you may choose either a new generation attempt or a full refund by contacting us. A delay caused by missing, inaccurate, or later-changed information does not begin or may restart the 72-hour period.

The Threshold

The Threshold is a one-time purchase of digital content delivered over thirty mornings. Delivery begins immediately with your welcome letter. By purchasing, you expressly request that delivery begin at once and acknowledge that, once it has begun, you lose any statutory right to withdraw, and that all sales of The Threshold are final and non-refundable, except where a refund is required by law or under Section 9's Mandatory consumer rights.

Your Sky Today

Your Sky Today is a recurring subscription. Fees already charged for the current period are non-refundable except where a refund is required by law or under Section 9's Mandatory consumer rights; cancelling stops the next charge.

Failed delivery and refunds

If we cannot provide a purchased reading, we will offer a new generation attempt or a full refund, at your choice. Approved refunds are generally returned to the original payment method. Financial institutions may take additional time to post them.

Live sessions

Live sessions are not currently sold through the portal. If a live session is arranged separately, any scheduling, cancellation, rescheduling, recording, or no-show terms disclosed on the booking page or in the booking confirmation will apply. If no additional term is provided, applicable law controls.

Mandatory consumer rights

Nothing in these Terms limits a refund, cancellation, conformity, or other consumer right that cannot lawfully be waived.

If the law where you live gives you a withdrawal period for online services or digital content, that right applies. Because a reading is generated for you within minutes of payment and question credits are available immediately, the checkout page states, above the payment button, that delivery begins at once and that your right to withdraw ends once the reading has been generated or a credit has been used. By completing the purchase you confirm that you want performance to begin immediately. The portal records that confirmation with your purchase. If that confirmation was not obtained where the law requires it, your statutory rights remain unaffected.

10. Your content and permission to process it

"User Content" means information you submit to the Services, including birth details, questions, messages, relationship context, and feedback. As between you and Star Phlux, you retain any rights you hold in your User Content.

You give Star Phlux a non-exclusive, worldwide, royalty-free license to host, copy, transmit, format, calculate from, analyze, summarize, and otherwise process User Content only as reasonably necessary to:

• provide, personalize, store, and support the Services you request;
• share content with a connected adult or another recipient at your direction;
• use service providers described in the Privacy Policy;
• maintain private memory and conversation continuity;
• audit accuracy, investigate problems, secure and improve the Services without training an AI model on customer conversations; and
• comply with law and enforce these Terms.

This license lasts only as long as reasonably necessary for those purposes, subject to retention required or permitted by law. You remain responsible for your User Content and the rights needed to submit it.

If you voluntarily provide suggestions about Star Phlux that are not personal account content, you permit us to use them without restriction or compensation, but you are not required to provide feedback.

11. Star Phlux materials and your reading license

The Services—including their software, visual design, trademarks, written materials, prompts, selection and arrangement of interpretive content, methods, and other Star Phlux or licensor materials—are protected by intellectual-property and other laws. Except for the limited permissions in these Terms, no rights are transferred to you.

Subject to these Terms, Star Phlux gives you a personal, non-exclusive, non-transferable license to access the Services you have purchased or received and to download, retain, and privately share your completed reading with people you choose. You may not publicly republish, commercially exploit, sell, sublicense, mass distribute, or present a reading or other Star Phlux material as a product or service created by you.

AI-generated material may not be unique, and another user may receive similar language or themes. We do not promise that an output is eligible for copyright protection or that it will not resemble other content. Your license does not grant rights in another person's personal information or in third-party materials.

12. Acceptable use

You may not use the Services to:

• violate any law or another person's intellectual-property, privacy, publicity, confidentiality, contractual, or other rights;
• submit information about a minor or information about an adult that you have no legal right to provide;
• harass, stalk, threaten, exploit, discriminate against, defame, manipulate, or harm another person;
• impersonate anyone or misrepresent your identity, authority, relationship, or intentions;
• seek or provide medical, mental-health, legal, financial, safety-critical, or other regulated professional decisions through the Services;
• make decisions about another person concerning employment, housing, education, credit, insurance, healthcare, legal services, or another high-impact area;
• upload malicious code, interfere with systems, test vulnerabilities without written authorization, bypass access or credit controls, or obtain data not intended for you;
• scrape, crawl, use automated queries, extract system prompts or protected datasets, reverse engineer, reproduce, or create a competing service from Star Phlux materials, except to the limited extent a restriction is prohibited by law;
• resell accounts, credits, readings, or access to the Services; or
• use Star Phlux or its outputs to train or evaluate an AI model without our written permission.

We may investigate suspected violations and remove content, restrict features, or suspend access when reasonably necessary.

13. Communications

You agree that we may communicate electronically through email, the portal, or notices on the website about your account, login, purchases, invitations, readings, security, these Terms, and operation of the Services. Electronic notices satisfy any legal requirement that a communication be in writing to the extent permitted by law.

Text messages (the morning letters and Your Sky Today)

If you opt in to text messages for the morning letters or Your Sky Today, the following terms apply:

• Program. Star Phlux sends one text each morning with a link to that day's letter or read: for the length of the letters (about 30 messages), or for as long as your Your Sky Today subscription is active, plus a confirmation text when you opt in and replies to STOP and HELP. Texts are optional, and consent to receive them is not a condition of any purchase.
• How you opt in. You give a mobile number on your course page or in your account settings and check the consent box. Texting START, YES, or UNSTOP to our number also opts you in.
• Cost. Message and data rates may apply. Star Phlux does not charge for the texts; your carrier's rates apply.
• How to stop. Reply STOP to any message to end the texts, or remove your number in your account settings. You will receive one confirmation text that you have been unsubscribed. Stopping the texts does not affect the email letters or your access to the course.
• Help. Reply HELP to any message or email admin@starphlux.com.
• Carriers. Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device, and messages may be delayed or fail; a missed text does not create a refund right because the letter is always available by email and on your course page.
• Your mobile information. How we handle your mobile number is described in the Privacy Policy. We do not share mobile numbers or text-message opt-in information with third parties or affiliates for their marketing or promotional purposes.

We may send promotional communications where permitted by law. You may opt out of promotional messages using the instructions in the message or by emailing admin@starphlux.com. Opting out does not stop essential service or account messages.

14. Third-party services

The Services depend on third parties such as hosting, authentication, network-delivery, AI, place-lookup, email, text-message, and payment providers. Place lookup uses the GeoNames geographical database, licensed under the Creative Commons Attribution 4.0 licence; chart calculation uses the Swiss Ephemeris by Astrodienst AG under its licence. Their services may be subject to separate terms and may change, become unavailable, or produce errors. Star Phlux is not responsible for a third party's independent acts or services, but this sentence does not limit any responsibility that cannot lawfully be excluded.

Links to third-party websites are provided for convenience and do not imply endorsement. You are responsible for reviewing third-party terms that apply directly to you.

15. Suspension and termination

You may stop using the Services at any time and may request account deletion as described in the Privacy Policy. Closing an account does not create a refund right beyond Section 9 or applicable law, so request any available refund before closing the account.

We may suspend or terminate access, remove content, or restrict features if we reasonably believe you engaged in fraud, abused a person or the Services, submitted unlawful content, interfered with a system, shared login credentials, created a safety or security risk, harmed or threatened others, failed to pay, or materially violated these Terms. Where reasonable, we will provide notice and an opportunity to correct the issue.

If we terminate your account for our convenience rather than for fraud or abuse, we will refund the unused portion of paid question credits on a proportionate basis. No refund is required for termination based on fraud or abuse except where applicable law requires one.

Upon termination, your right to use the Services ends. Sections that by their nature should survive—including provisions concerning accrued payment obligations, intellectual property, disclaimers, liability, indemnification, disputes, and general terms—will survive. Personal information is handled after termination as described in the Privacy Policy.

16. Service availability and changes

We work to keep the Services available but do not guarantee uninterrupted, error-free, or permanent access. Maintenance, provider outages, security issues, legal requirements, or events outside our reasonable control may delay or prevent access. Do not rely on Star Phlux as the only copy of information you need; download completed readings you wish to keep.

We may change or discontinue unpaid features at any time. If a material change prevents us from providing a paid, undelivered Service or honoring unused paid credits, the remedies in Sections 8 and 9 apply.

17. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." STAR PHLUX DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND RESULTS.

We do not warrant that the Services will be uninterrupted, secure, error-free, complete, current, or compatible with every device; that defects will be corrected; or that any chart, interpretation, answer, date, recommendation, or other output is accurate or suitable for your circumstances. Chart quality depends on the accuracy and completeness of birth details and on third-party geographic, time-zone, ephemeris, hosting, and AI systems.

Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions apply only to the extent permitted, and mandatory consumer guarantees remain in effect.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAR PHLUX AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, OR EXPECTED BENEFITS, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF STAR PHLUX AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID STAR PHLUX DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $50.

These limitations do not apply to liability that cannot lawfully be limited or excluded, which may include liability for fraud, willful misconduct, or death or personal injury caused by negligence in certain jurisdictions. They do not reduce any non-waivable consumer remedy.

19. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Star Phlux and its owners, officers, employees, and contractors from third-party claims, damages, judgments, and reasonable costs arising from your unlawful User Content, your submission of another person's information without the required rights, your infringement of another person's rights, or your intentional or material violation of these Terms. This obligation does not apply to the extent a claim was caused by Star Phlux's own unlawful conduct, negligence, or breach.

We will promptly notify you of a covered claim and allow you to control the defense and settlement, provided you may not agree to a settlement that admits fault by or imposes an obligation on Star Phlux without our written consent. We may participate through counsel at our own expense.

20. Governing law and disputes

Before filing a claim, you and Star Phlux agree to try in good faith to resolve the dispute informally. Send a written description of the dispute and requested resolution to admin@starphlux.com. We will do the same using the email address associated with your account. Either party may proceed after 30 days if the dispute is not resolved, unless an immediate filing is reasonably necessary to preserve a legal right.

These Terms are governed by California law, without regard to conflict-of-law rules. Subject to any mandatory consumer right to bring a claim elsewhere, the state and federal courts located in Los Angeles County, California will have exclusive jurisdiction, and each party consents to personal jurisdiction there.

These Terms do not require arbitration and do not waive any right to a jury trial or class proceeding. Nothing in this section deprives a consumer of mandatory protections or forums available under the law of the consumer's habitual residence.

21. Changes to these Terms

We may update these Terms prospectively to reflect changes to the Services, providers, business practices, or law. We will post the revised Terms with a new effective date. For material changes, we will provide reasonable additional notice and obtain renewed acceptance when required. Changes do not retroactively alter an existing dispute or reduce rights in a completed purchase.

Your continued use after updated Terms take effect means you accept them, except where law requires a different form of consent. If you do not agree to an update, stop using the Services and contact us about closing your account and any remaining paid credits.

22. General terms

These Terms, the Privacy Policy, and any offering-specific terms form the entire agreement between you and Star Phlux concerning the Services and replace prior agreements about the same subject. You may not assign your rights or obligations without our written consent. We may assign these Terms in connection with a merger, reorganization, financing, or sale of all or part of our business, subject to applicable law.

If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. Headings are for convenience only. These Terms do not create an employment, partnership, joint venture, agency, fiduciary, or franchise relationship.

Neither party is liable for delay or failure caused by events beyond its reasonable control, except that this does not excuse payment obligations already incurred or duties that cannot lawfully be excluded.
